Babeland® Sex Toy Design Contest

Rules and Eligibility

Welcome to Project Sex Toy, the first Babeland® sex toy design contest. If you've ever dreamed of the perfect sex toy, now's the time to dust off your drawing board and show us what you've got! The mission of this contest is to encourage our customers to share their creative excellence in the design of sex toys, and to recognize such creativity.  Babeland® is recognized around the world as a friendly place for women and men to shop for sex toys, books, and videos, and is the premier bi-coastal, women-friendly sex toy store with a brand new store in Los Angeles, two locations in New York City, a flagship store in Seattle, and a website: www.babeland.com.

Project Sex Toy is a multi-tiered contest. All entries received will initially be judged by a core group of Babeland® employees, who will narrow the field of entries to a group of “finalists.” Finalists will advance to the next tier. Finalists will be judged online by Babeland® customers and in person by a panel of judges including toy manufacturers, celebrities, and sexperts.  Selection of the winning entries is effected by a scoring process in which judging evaluates all creative elements of every entry.  All entries will be judged on the following criteria but ultimately, all judging will be based on the subjective evaluation by the judges in their sole discretion: 

1. Viability
2. Originality of design
3. Functionality and safety
4. Aesthetics
5. Ability to advance the cause of human sexuality

First, Second, and Third Place winners will be chosen. All decisions are final and not subject to appeal by entrants.

HOW TO ENTER

Print the entry application form out and fill in all necessary information. You may also pick up an entry application at one of our four retail stores. You may also request an application be mailed to you by calling 1-800-658-9119.

DEADLINE Extended to June 14, 2006!

All entries must be mailed or provided by overnight mail, or emailed, and must be received by June 14, 2006. We are sorry but postmarking an entry on or after June 14 will result in an untimely entry and will not be accepted; again, all entries must be RECEIVED on or before June 14, 2006. Faxed entries are also not accepted.

ELIGIBILITY

All entrants must be 18 years of age or older.

By participating in this contest, you are agreeing to the terms and conditions of the contest. The rules of the contest are established in the sole discretion of Babeland®.  Employees of Babeland®, their relatives or persons residing in their respective households are not eligible for entry, directly or indirectly.  Babeland® reserves the right, in its sole discretion to cancel, modify, or suspend this contest, and randomly award the prizes from among all eligible entries received prior to action taken by Babeland®. 

By entering the contest, you are representing that you are the person who created the design, and have all rights in that design. Copyright infringement or other intellectual property infringement and/or plagiarism (be it intentional or unintentional) will result in disqualification and, if applicable, removal of awards from any entry deemed in violation.

The contest is open to residents both within and outside of the United States. 

ALL ENTRIES MUST:

• Meet all eligibility and deadline requirements.
• Include a complete and signed entry application form; Entrants must have a valid email and mailing address, and if they desire to be contacted by phone, a valid phone number must be included.
• Conform to all laws in their jurisdiction.
• Conform to defined submission requirements.
• Conform to all copyright and other intellectual property laws.

ENTRY SUBMISSION

Both two-dimensional and three-dimensional entries will be accepted. Two-dimensional entries should be no larger than 20”x30”. Three-dimensional entries should be no larger than 24”x24”x12”. Entries should not weigh more than 10 pounds. Please make sure that your full name and phone number are affixed to the underside or backside of your entry. No information identifying the entrant should appear on the face of the entry.

Entries may also be submitted via email using the following criteria: Emailed entries must be submitted as attachments using only PDF, GIF, or JPEG format. Entries must be print-ready, not to exceed 8-1/2" x 11". No information identifying the entrant should appear on the face of the entry. Emailed entries must be accompanied by a copy of the signed entry application attached to the email in PDF, GIF, or JPEG format only (no Word documents). Please remember that all entries must be received by June 14, 2006.  Babeland® is not responsible for computer system, phone line, hardware, software or program malfunctions, or other errors, failures, or delays in computer transmissions or network connections that are human or technical in nature, so ensure to allow time of your entry to allow for any such problems.  Confirmation of receipt of emails will not be provided. You may submit more than one entry however each entry must be sent separately.

While the creator of the design may own the “copyright” to such design, by submission of an entry, you expressly grant to Babeland® the irrevocable and perpetual license and full rights and permission to use such entries and/or their digital or other image or medium for publication, exhibition, and marketing of the Project Sex Toy contest in our retail stores and on our present or future web site(s), in advertising and for other purposes in any medium connected with the contest or display the entry in any and all manner and media throughout the world, including, but not limited to, print, photograph, film, video, television, CD-ROM, DVD, and online computer media, such as the Internet or digital imaging.  By submitting an entry, you forever waive any right to inspect or approve of any use made by Babeland® of the entry for the purposes stated herein or advertising copy or printed matter that may be used in conjunction therewith or to the eventual use that it might be applied.  However, this grant of license and rights does not grant Babeland® the right to develop or market the product represented by the entry.  Babeland® does not guarantee or commit that it will publish or use the image of any entry, including the winning entries.

We’re sorry, but entries will not be returned.                       

SHIPMENT OF ENTRIES

After preparing your entry in the manner outlined in this guide, send your entry along with two copies of the entry application form, postage paid, to:

As stated above, entries may also be emailed using the specified criteria. Emailed entries may be sent to contest@babeland.com, provided that they conform with the guidelines and rules, including timely entry.

PRIZES

1. First prize: $250 cash; $250 Babeland® gift certificate; package of assorted toys
2. Second prize: $150 cash; $150 Babeland® gift certificate; package of assorted toys
3. Third prize: $75 cash; $75 Babeland® gift certificate; package of assorted toys

Winner will be responsible for all income taxes on prize.

Any winner who resides in a country or region that does not accept shipments of sex devices must forfeit that portion of their prize.

DISCLAIMERS

This contest is for fun and to draw on the creativity and knowledge of our customers, and to further the Babeland® mission.  The fact of having a “winning entry” or meetings with vendors that may be awarded as part of any prize are for prize and informational purposes, and are not a commitment on the part of Babeland® or any vendor to develop, manufacture, market, or otherwise commercially or otherwise produce or exploit any product represented by an entry. 

The winners will be required to sign and return an affidavit of eligibility, a publicity/liability release and any other required documentation within 28 days following attempted notification. Failure to comply within this time period will result in disqualification and selection of an alternate winner.

By participating, entrants and winner releases Babeland®, its respective parents, affiliates, and subsidiaries, and their respective directors, officers, agents, and employees, from any and all liability with respect to all aspects of the contest and/or use of any prize. Winner further agrees to the use of his/her name, and city and state of residence for purposes of providing a list of winners to the public on request and for advertising and promotional purposes without further compensation, unless prohibited by law.  All entrants further agree by submitting an entry that he or she agrees to defend, indemnify and hold harmless Babeland®, its representatives, assigns, employees or any person or persons, corporation or corporations, acting under its permission or authority, or any person or persons, corporation or corporations, for whom it might be acting and any firm publishing and/or distributing the finished product, in whole or in part, from and against any liability as a result of any claim of copyright or other intellectual property infringement.

Babeland® reserves the right at its sole discretion, to disqualify any individual (and all of his or her entries) who tampers with the entry process.
